WEBSITE TERMS AND CONDITIONS

These Website Terms and Conditions (Terms) govern your access to and use of the Honeydew Hire website at www.honeydewhire.com.au (Website) and any associated pages, channels, content and services operated by Honeydew Hire, including Honeydew Hire's social media accounts at Instagram (@honeydewhire), TikTok and any other social media platform operated by Honeydew Hire from time to time (Social Channels).

In these Terms, “Honeydew Hire”, “we”, “us” and “our” means Amelia Malone trading as Honeydew Hire (ABN 32 492 573 448), of Hunter Valley, New South Wales 2325. “You” and “your” means the person accessing or using the Website.

By accessing or using the Website, you acknowledge that you have read, understood and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Website.

1. About Honeydew Hire and the Website

  1. Honeydew Hire is an event hire business based in the Hunter Valley region of New South Wales. Honeydew Hire provides hire of event and styling items for weddings, engagements, birthdays, corporate events, styled shoots and similar events, on a Dry Hire or Wet Hire basis.

  2. Honeydew Hire provides services within New South Wales, with a focus on the Hunter Valley region and surrounding areas. Service availability outside these areas is at Honeydew Hire's discretion and may be subject to additional fees and conditions.

  3. The Website is a brochure-style website that provides information about Honeydew Hire, its Hire Items, examples of past work, testimonials and a means for visitors to submit enquiries and request quotes. No Bookings are completed through the Website. All Bookings are made through a separate Proposal issued by Honeydew Hire and accepted by the client in accordance with Honeydew Hire's Hire Agreement.

2. Enquiries and quotes

  1. The Website allows you to submit enquiries and request quotes by completing an enquiry or contact form, by emailing info@honeydewhire.com.au or by sending a direct message via the Social Channels.

  2. Submitting an enquiry or requesting a quote does not create a Booking or any contractual obligation. Honeydew Hire is not obliged to accept any enquiry or to provide a quote, and may decline any enquiry at its discretion.

  3. Any quote provided by Honeydew Hire is provided as a Proposal in accordance with Honeydew Hire's Hire Agreement. A Booking is only confirmed once a Proposal has been accepted and the Deposit has been received in cleared funds, in accordance with the Hire Agreement.

  4. Quotes are valid for the period specified by Honeydew Hire and, in the absence of a specified period, for 7 days from the date of issue. Honeydew Hire may revise or withdraw a quote at any time before acceptance.

  5. Any indicative pricing, estimate, ballpark, guide, draft or preliminary figure provided by Honeydew Hire (including by direct message, email, social media, verbally or by any other means) does not constitute a Proposal, a binding offer or a quote. Only a written document expressly described as a "Proposal" and issued by Honeydew Hire constitutes a Proposal. No Booking is created until a Proposal is accepted and the Deposit is paid in cleared funds in accordance with the Hire Agreement.

  6. Honeydew Hire accepts Bookings on a rolling basis and confirms Event Dates up to 8 months in advance. Availability for Event Dates outside that window is at Honeydew Hire's sole discretion. Honeydew Hire reserves the right to release or withhold Event Dates at any time before a Proposal has been accepted and the Deposit paid.

3. Use of the Website

  1. You may use the Website only for lawful purposes and in accordance with these Terms. You must not use the Website in any way that:

    1. breaches any applicable law or regulation;

    2. infringes the rights of Honeydew Hire or any third party, including intellectual property rights, privacy rights or rights of publicity;

    3. is fraudulent, false, misleading or deceptive;

    4. is defamatory, obscene, offensive, harassing, threatening or otherwise objectionable;

    5. introduces or transmits any virus, malware, spyware or other malicious code;

    6. attempts to gain unauthorised access to the Website, any server, network or system connected to the Website, or any account or data of another user;

    7. scrapes, harvests, mines or otherwise collects data from the Website by automated or systematic means;

    8. interferes with or disrupts the operation of the Website or the servers or networks supporting it;

    9. uses the Website to send unsolicited marketing or commercial communications; or

    10. uses any image, photograph, content or material from the Website (including any of Honeydew Hire's Hire Items, styling images or branded content) for the purpose of training any artificial intelligence or machine learning model, without Honeydew Hire's prior written consent.

  2. Honeydew Hire reserves the right to suspend, restrict or terminate your access to the Website at any time, without notice and without liability, where Honeydew Hire reasonably considers that you have breached these Terms.

4. Intellectual property

  1. All content on the Website, including text, photographs, images, graphics, designs, logos, layouts, mood boards, video, audio, branding, copy and the overall look and feel of the Website (Website Content), is owned by Honeydew Hire or used under licence. The Website Content is protected by Australian and international copyright, trade mark, designs and other intellectual property laws.

  2. Honeydew Hire grants you a limited, personal, non-exclusive, non-transferable and revocable licence to access and view the Website Content for the purpose of considering Honeydew Hire's services, submitting an enquiry or requesting a quote. This licence does not permit any commercial use or any other use of the Website Content.

  3. Except as expressly permitted by these Terms or by law, you must not, without Honeydew Hire's prior written consent:

    1. reproduce, copy, download (other than for ordinary browser caching), print (other than for personal reference), distribute, publish, transmit or otherwise share any of the Website Content;

    2. modify, adapt, translate, reverse engineer, create derivative works from or otherwise alter any of the Website Content;

    3. use the Website Content for any commercial purpose, including for inclusion in any other website, publication, advertising material, social media post, mood board or portfolio;

    4. use the Website Content to compete with Honeydew Hire or to assist any third party to do so; or

    5. remove, obscure or alter any copyright, trade mark, watermark or other proprietary notice on or in the Website Content.

  4. The Honeydew Hire name, logo and any other trade marks displayed on the Website are trade marks of Honeydew Hire. You must not use any Honeydew Hire trade mark without Honeydew Hire's prior written consent.

  5. Where you submit any content to Honeydew Hire (including via the enquiry form, by email or by social media), you grant Honeydew Hire a worldwide, royalty-free, non-exclusive licence to use, reproduce, publish, communicate and adapt that content for the purpose of responding to your enquiry, providing the Services and operating its business. You warrant that you own or have all necessary rights in any content you submit and that the content does not infringe the rights of any third party.

5. Testimonials, galleries and event imagery

  1. The Website and Social Channels may feature testimonials, reviews, galleries, photographs and video of past Events at which Honeydew Hire has supplied Hire Items. Honeydew Hire only publishes such content where it has the right to do so, including the consent of the relevant photographer, client or venue where required.

  2. Honeydew Hire takes reasonable care to ensure that testimonials, reviews and event imagery published on the Website are accurate, but does not warrant or guarantee that they reflect the experience of every client or the outcome of every Event. Each Event is unique and outcomes depend on factors specific to the Event, venue and Client.

  3. Photographs and imagery published on the Website and Social Channels often depict styled Events that include items, props, florals, styling elements, furniture and other materials not supplied by Honeydew Hire. The presence of any item in a photograph or image does not constitute a representation that Honeydew Hire supplies, owns, or can supply that item. The Hire Items available from Honeydew Hire are limited to those identified in a Proposal.

  4. If you are a past or current client, photographer or venue and you wish to request the removal of any image or content relating to you or your Event, please contact Honeydew Hire using the details in clause 13.

6. Blog and journal content

  1. The Website may include a blog, journal or other editorial content (Editorial Content) which may include articles, styling tips, inspiration boards, real Event features and other materials.

  2. Editorial Content is provided for general information and inspiration purposes only. It is not professional advice, including not professional event design, styling, financial, legal, health, safety or other advice. You should not rely on Editorial Content as the sole basis for any decision and you should seek independent professional advice where appropriate.

  3. Honeydew Hire does not warrant that Editorial Content is current, accurate, complete or suitable for your purposes. Honeydew Hire may amend, replace or remove Editorial Content at any time without notice.

7. Third-party links and content

  1. The Website may include links to third-party websites, services, platforms and content, including links to Honeydew Hire's Social Channels, payment platforms and partners. Honeydew Hire provides those links for convenience only.

  2. Honeydew Hire does not endorse, sponsor, approve or accept responsibility for any third-party website or content. Your use of any third-party website or content is at your own risk and is subject to the terms and privacy policies of that third party.

8. Social channels

  1. Honeydew Hire operates social media accounts including Instagram (@honeydewhire), TikTok and any other social media platform operated by Honeydew Hire from time to time (Social Channels). The Social Channels are operated by Honeydew Hire but hosted by third-party platforms whose terms and policies govern your use of those platforms.

  2. Comments, direct messages and other interactions on the Social Channels are public or visible to the relevant platform. Honeydew Hire is not responsible for content posted by third parties on the Social Channels and reserves the right to delete, hide or moderate any content that is offensive, defamatory, misleading, unlawful or otherwise inappropriate.

  3. Submitting an enquiry or making a booking request via the Social Channels does not create a Booking. All Bookings must be confirmed in accordance with Honeydew Hire's Hire Agreement.

9. Availability and changes to the Website

  1. Honeydew Hire endeavours to keep the Website available at all times but does not warrant or guarantee that the Website will be available, uninterrupted, error-free, secure or free from viruses or other harmful components.

  2. Honeydew Hire may, at any time and without notice, modify, suspend, withdraw or discontinue any part of the Website, including any feature, page, content or service. Honeydew Hire is not liable to you or any third party for any modification, suspension, withdrawal or discontinuation of the Website.

  3. Honeydew Hire may amend these Terms from time to time. The current version of the Terms will be available on the Website. The “Effective Date” at the top of these Terms indicates when they were last updated. Your continued use of the Website after any amendment constitutes your acceptance of the amended Terms.

10. Disclaimer

  1. To the maximum extent permitted by law, the Website and the Website Content are provided on an “as is” and “as available” basis, without any representation, warranty or guarantee of any kind, whether express or implied.

  2. Honeydew Hire does not warrant that:

    1. the Website or Website Content will meet your requirements;

    2. the Website will be available, secure, uninterrupted or error-free;

    3. any information on the Website is accurate, complete, current or reliable;

    4. any Hire Items shown on the Website will be available for any particular Event Date; or

    5. the Website is free from viruses, malware or other harmful components.

  3. Photographs, images, video, styling examples, designs and depictions of Hire Items on the Website and Social Channels are intended to provide a general impression of Honeydew Hire's Hire Items and past work. Colours, finishes, sizes, dimensions, materials, condition and styling may vary from those depicted, and individual Hire Items may differ in appearance due to age, use, repair, batch or natural variation. Some photographs may depict items, designs, styling elements, props, furniture or florals that are not supplied by Honeydew Hire and that are not available for hire.

  4. Honeydew Hire does not warrant or guarantee that any Hire Item, design or styling element shown on the Website is suitable for your Event, your venue, your guest numbers, the conditions of use, the location, the weather conditions, or any specific aesthetic, purpose or outcome you may have in mind. You are solely responsible for:

    1. selecting Hire Items that are appropriate for your Event, venue and intended use;

    2. checking the dimensions, weight, capacity, power requirements, safety considerations and venue restrictions applicable to any Hire Item you wish to hire;

    3. confirming with your venue that the Hire Items are permitted at the venue and can be accommodated safely; and

    4. seeking independent professional advice (including from event planners, stylists, venue operators or engineers) where appropriate.

  5. Where you have a question about a Hire Item's suitability, dimensions, condition or specifications, you should contact Honeydew Hire before submitting an enquiry or confirming a Booking. Reliance on photographs or descriptions on the Website without confirming with Honeydew Hire is at your own risk.

  6. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that you have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.

11. Limitation of liability

  1. To the maximum extent permitted by law, Honeydew Hire excludes all liability (whether in contract, tort, negligence, statute or otherwise) for any loss, damage, cost or expense suffered by you or any third party in connection with your access to or use of the Website, including any loss, damage, cost or expense arising from:

    1. any error, omission, inaccuracy or out-of-date information in the Website Content;

    2. any unavailability, interruption, suspension or discontinuation of the Website;

    3. any virus, malware or other harmful component transmitted through the Website;

    4. any unauthorised access to or alteration of your communications, data or transmissions; or

    5. any act or omission of any third party, including any third-party website, platform or service linked from the Website.

  2. Where Honeydew Hire's liability cannot lawfully be excluded but can be limited, Honeydew Hire's total liability to you in connection with your access to or use of the Website is, at Honeydew Hire's election, limited to the resupply of the relevant service or the cost of having the service resupplied.

  3. In no event will Honeydew Hire be liable to you for any indirect, consequential, special, punitive or exemplary damages, including loss of business, loss of revenue, loss of profits, loss of opportunity or loss of data.

  4. You indemnify Honeydew Hire against any Claim brought against Honeydew Hire by a third party arising from your breach of these Terms, your unlawful use of the Website, or your infringement of any right of Honeydew Hire or any third party.

12. Privacy

  1. Honeydew Hire's collection, use, holding and disclosure of personal information is governed by Honeydew Hire's Privacy Policy, available on the Website. By using the Website, you acknowledge that you have read and understood the Privacy Policy.

14. Governing law and jurisdiction

  1. These Terms are governed by the laws of New South Wales, Australia.

  2. You submit to the non-exclusive jurisdiction of the courts of New South Wales and courts competent to hear appeals from those courts in respect of any dispute, claim or proceeding arising out of or in connection with these Terms or your use of the Website.

15. General

  1. If any provision of these Terms is held to be invalid, illegal or unenforceable, that provision will be read down to the extent necessary to make it valid, legal and enforceable. If it cannot be read down, it will be severed and the remaining provisions will continue in full force and effect.

  2. A failure or delay by Honeydew Hire in exercising any right under these Terms is not a waiver of that right. A waiver by Honeydew Hire of any right is not effective unless given in writing.

  3. These Terms, together with Honeydew Hire's Privacy Policy and (where applicable) Honeydew Hire's Hire Agreement, constitute the entire agreement between you and Honeydew Hire in relation to your use of the Website and supersede all prior agreements, representations and understandings.

  4. You may not assign, transfer or otherwise deal with your rights or obligations under these Terms without Honeydew Hire's prior written consent. Honeydew Hire may assign, novate or otherwise deal with its rights and obligations under these Terms without your consent.
